1. Acceptance of Terms
By accessing or using Recovery Ride, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
Recovery Ride is an online marketplace platform that connects buyers and sellers of cycling equipment, including bikes, frames, components, and accessories.
Important: Marketplace Only
Recovery Ride is a venue that facilitates transactions between independent buyers and sellers. We are not a party to any transaction. All purchases are made directly from sellers, who are solely responsible for their listings, item descriptions, pricing, shipping, and customer service. Recovery Ride does not own, possess, or inspect items listed on the platform.
3. User Accounts
- You must be at least 18 years old to create an account
- You are responsible for maintaining the security of your account
- You must provide accurate and complete information
- One person or entity may maintain only one account
- You are responsible for all activity under your account
4. Seller Responsibilities
As a seller on Recovery Ride, you are solely responsible for:
- Providing accurate, complete, and honest descriptions of your items
- Uploading photos that accurately represent the item's condition
- Only listing items you legally own and have the right to sell
- Shipping items promptly after payment is received
- Properly packaging items to prevent damage during shipping
- Providing valid tracking information when shipping
- Honoring the prices and terms you set for your listings
- Responding to buyer inquiries in a timely manner
- Complying with all applicable laws regarding the sale of goods
- Not listing prohibited items (stolen goods, counterfeit items, recalled products, etc.)
Sellers are independent parties, not employees or agents of Recovery Ride. Any warranties or guarantees regarding items are between the seller and buyer only.
5. Buyer Responsibilities
As a buyer on Recovery Ride, you are responsible for:
- Reading listing descriptions and examining photos carefully before purchasing
- Asking questions about items before committing to buy
- Providing accurate shipping and payment information
- Inspecting items promptly upon receipt
- Confirming delivery within a reasonable timeframe
- Communicating respectfully with sellers
- Reporting any issues with orders promptly through our platform
6. Payment and Payout Terms
All payments are processed securely through our payment processor (Stripe). When you make a purchase:
- Payment is captured immediately at checkout
- Funds are held securely until delivery is confirmed
- Seller payouts are processed after delivery confirmation
Automatic Payout Release
To protect both parties while ensuring sellers receive timely payment:
- Shipped orders: Payout is released 5 days after tracking shows delivered, or 10 days after shipping if no delivery confirmation is available
- Local pickup: Payout is released when the seller marks the pickup as complete
- Buyers should inspect items and report any issues before auto-release occurs
7. Fees
Recovery Ride charges service fees on completed transactions. Our current fee structure is available on our Fees page. We reserve the right to modify our fees with notice to users. Fees are non-refundable except as required by law or at our sole discretion.
8. Shipping and Delivery
Shipping is arranged between buyers and sellers. Recovery Ride does not provide shipping services.
- Sellers are responsible for shipping items as described in their listings
- Sellers should use trackable shipping methods and provide tracking information
- Risk of loss transfers to the buyer upon delivery (or upon handoff for local pickup)
- Recovery Ride is not responsible for items lost, damaged, or delayed in transit
- Shipping disputes should be directed to the shipping carrier
9. Disputes
We encourage buyers and sellers to resolve disputes directly through our messaging system.
- Buyers may open a dispute for items not received or significantly not as described
- Disputes must be opened before payout auto-release occurs
- Recovery Ride may, at our sole discretion, help mediate disputes
- We are not obligated to resolve disputes and our decisions are final
- Abuse of the dispute system may result in account suspension
10. Prohibited Conduct
You may not:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Post false, misleading, or fraudulent content
- List stolen, counterfeit, or recalled items
- Harass, abuse, or harm other users
- Attempt to circumvent our fees by taking transactions off-platform
- Share payment information (Venmo, PayPal, Cash App, etc.) in messages
- Use automated tools to access or scrape our platform
- Create multiple accounts or fake reviews
- Engage in any activity that disrupts our services
11. Limitation of Liability
RECOVERY RIDE PROVIDES THE PLATFORM "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Recovery Ride and its officers, directors, employees, and agents shall not be liable for:
- The conduct, actions, or content of any user
- The quality, safety, legality, or availability of items listed
- The accuracy of listing descriptions or photos
- Items that are lost, stolen, damaged, or delayed in shipping
- Any disputes between buyers and sellers
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or goodwill
Our total liability for any claim arising from your use of the platform shall not exceed the fees you have paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Recovery Ride and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.
13. Account Termination
We may suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also delete your account at any time. Upon termination, pending transactions will be handled at our discretion.
14. Changes to Terms
We may update these terms from time to time. We will notify users of material changes via email or platform notification. Continued use of the service after changes constitutes acceptance of the new terms.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Illinois.
